Introduction.
Criminal Code (Part 1 of Article 14) defines the crime as guilty of a socially dangerous act prohibited by the Criminal Code under threat of punishment. Nevertheless, improper behavior can be recognized as a criminal only when it constitutes a crime. The composition of the crime - a legal abstraction. The Criminal Code of the Russian Federation (Article 8) found that the basis of criminal responsibility is an act that contains all the elements of a crime under the Criminal Code.
One should distinguish the concept of "crime" of the concept of "corpus delicti".
Science criminal law defines the crime as a criminal guilty socially dangerous act prohibited by criminal law under threat of punishment.
From this definition we can derive the following elements of a crime:
- Wrongfulness
- Public danger
- Guilty
- Punishable
"The wrongfulness of evidence that the offender has violated the prohibition in criminal legal norm."
Public danger is the ability to act to harm the legally protected public relations.
Culpability "implies a certain mental attitude of the person to their behavior and its consequences."
