Product description
The Municipal Property Management Committee held an auction for the sale of non-residential premises. One of the conditions for admission to trading is that the participants in the auction enter certain amounts into the account of the auction organizer to confirm the seriousness of their intentions, which was recorded in separate written agreements about the deposit. The winner of the auction was recognized by Rassvet LLC. However, the contract of sale of real estate with him was not signed in due time by the fault of the organizer of the competition, who did not deny this fact. The transaction did not take place; the sum was returned to the settlement account of Rassvet, and it was deposited to participate in the auction in the amount of 500 thousand rubles.
Rassvet LLC appealed to the arbitration court with a claim to recover from the auction organizer another 500 thousand rubles.
