The seller appealed to the arbitration court with a claim to the buyer for the recovery from the last interest for the delay in the execution of a monetary obligation: payment for the value of goods under a purchase and sale agreement.
From the materials of the case it followed that payment for the goods was to be made from the letter of credit. During the term stipulated by the contract, the letter of credit was not opened, in connection with which the supplier declared a claim. Goods have not been shipped.
