On March 19, 1998, the Amur Regional Council of People’s Deputies passed and the Law of the Amur Region No. 64-OZ “On Municipal Service in the Amur Region” dated April 7, 1998, was signed and signed by the head of the Amur Region Administration. Subparagraph 5 of paragraph 3 of Article 23 of the said law establishes that a citizen cannot be accepted for municipal service in the Amur Region and be in the municipal service in case of close relationship or property with municipal employees, if their municipal service is connected with direct subordination or control one of them to another.
The acting prosecutor of the Amur Region appealed to the court declaring this rule of law to be contrary to federal law and invalid from the moment it was adopted.
