The Board of Directors of Kerama CJSC (Ekaterinburg) has appointed one of the co-owners of the company, Italian citizen Salvini, as the General Director of the company. He lives in Moscow on an annual visa. It is assumed that Salvini will manage the company remotely, arriving two to three times a month in Yekaterinburg.
The HR manager had a number of questions:
1. how to formalize the relationship of the company with Salvini (whether it is necessary to conclude an employment contract with him or civil law relations arise on the basis of a decision of the board of directors);
2. according to the legislation of which country (Russia or Italy), Salvini´s labor activity should be formalized;
3. What additional documents are needed to formalize relations with a foreign citizen;
4. Is it permissible that Salvini, taken on a permanent job, will be located outside its location;
5. How will the Director General´s trips from Moscow to Yekaterinburg be arranged, and is the CJSC obliged to compensate him for travel and accommodation expenses?
