Product description
CJSC "Steklonit" concluded a contract with the Belsk Shipping Company for the carriage of goods in direct rail-water traffic. The cargo transported in a container was delivered to the destination with traces of a miss. ZAO Steklonit filed a claim against the South Ural Railway for recovery of damages arising from the devaluation of damaged cargo. The claim filed by the plaintiff rejected the claim, referring to the fault of the consignor, who loaded the cargo into a technically faulty container that had divergences of welds in the roof, which was recorded in a commercial act. CJSC Steklonit insisted on satisfaction of claims, indicating that responsibility for damage to the cargo should be placed on the railway, as it was obliged to check the serviceability and integrity of the container when it was accepted for transportation.
