3. The challenge
Citizen Pugovkin, at his request, was assigned a part-time work lasting four hours with a five-day work week. When Pugovkin was granted annual paid leave, the duration of the leave was reduced in proportion to the length of the working week. Considering that his rights to annual paid leave were violated, Pugovkin turned to the federal labor inspectorate.
In the role of the state labor inspector, give a legally sound written answer to Pugovkin and draw up an order to the employer.
The inspection will answer that Pugovkin’s rights are violated.
Article 93 of the Labor Code of the Russian Federation “Part-time” states:
“By agreement between the employee and the employer, part-time (shift) or part-time work may be established both during employment and subsequently. An employer is required to establish a part-time (shift) or part-time work at the request of a pregnant woman, one of the parents (guardian, guardian) who has a child under the age of fourteen (a disabled child under the age of eighteen years), as well as a person exercising care for a sick family member in accordance with a medical certificate issued in the manner prescribed by federal laws and other regulatory legal acts of the Russian Federation.
When working on a part-time basis, the employee is paid in proportion to the time worked by him or depending on the amount of work performed by him. Part-time work does not entail any restrictions on the length of annual basic paid leave, the calculation of seniority, or other labor rights. ”
