The Ministry of Defense, which is in charge of the federal unitary enterprise Energia, issued an order according to which its directors Ivanov were held fully liable for damage caused by an accident in the power supply system of the enterprise. The amount of damage is the sum of the cost of damaged electrical equipment that cannot be repaired, the cost of repairing electric networks and the losses incurred by it from downtime for five working days.
Ivanov appealed the decision of the employer. At the hearing, he explained that the accident was due to the fault of an electrician who, when intoxicated, began repairing the electrical wiring and violated the rules of work, which led to a malfunction in the electrical system. In addition, the plaintiff argued that the contract on full liability was not concluded with him, and therefore he should not bear it.
The defendant submitted to the court an employment contract concluded with Ivanov, which contained a condition on his full liability for the damage caused to the employer.
