On November 17, 2005, Selenin bought a freezer in a store that was manufactured on March 27, 2005, and paid 4,000 rubles for it. The warranty period of the camera is 3 years.
On December 20, 2005, it stopped working: it turned out that the filling tube was poorly welded.
On December 21 of the same year, the buyer contacted the seller and demanded to replace the freezer with a new, serviceable one, within 15 days. For the period of replacement, he asked to provide him with a similar product.
Since the buyer´s claims were not satisfied, on January 10, 2006 he filed a lawsuit. Selenin asked to recover from the defendant a penalty for failure to comply with the requirement to replace the goods and for failure to provide a similar product for the period of replacement in the amount of 10% of its cost, to pay damages in the amount of 1000 rubles. .
