The decision of the arbitral tribunal satisfied the requirement of 12 Chairs OJSC to challenge the actions of the bailiff to enforce the decisions of the arbitration courts to recover money from the LLC. The interests of the company in court were represented by the lawyer O. Bender, who, under the terms of the agreement concluded with him, the company, after the court decision entered into force, paid a fee of 7 thousand rubles.
OJSC appealed to the arbitration court with a request to recover representation expenses from the bailiff. By the ruling of the arbitration court, the application was denied by the OJSC with reference to the fact that this issue is subject to resolution in the general (lawsuit) order. OJSC 12 Chairs appealed to the arbitration court with the Ministry of Finance of the Russian Federation to recover costs for paying the services of a lawyer O. Bender.
