Tokar Mashkov reprimanded

Tokar Mashkov was reprimanded for working on the machine without safety glasses, and locksmith Domogarov was reprimanded for refusing a medical examination. Three days later, Mashkov was again seen working without safety glasses, and Domogarov again refused to undergo a medical examination. Mashkov was a member of the trade union, but Domogarov was not. The administration of the enterprise turned to the trade union committee to obtain consent for the dismissal of Mashkov and Domogarov under paragraph 5 of Art. 81 TKRF.
Are the actions of the administration legitimate?
