Volsky, being in hostile relations with his mother-in-law Pankratieva, promised to make her life unbearable. To do this, he bought the Moskvich-412 car, dismantled the muffler, and then parked the car on the side of the road under the windows of the private house of Pankratieva and left the engine on every day for the period from 8 to 22 hours.
Pankratyeva complained about the unbearable noise to the district police officer Laptev, stating that Volsky does not have a driver´s license, does not use the car as a means of transportation, but purchased and uses it solely for the purpose of inconvenience to Pankratieva.
Having considered the complaint, Laptev explained to Pankratieva that Volsky is the legal owner of the car, and therefore has the right to use his property at his own discretion. Volsky does not break the silence at night, the car was parked in the permitted place, and no one, except Pankratieva, complained about Volsky’s actions. Pankratieva consulted a lawyer.
